KILFROST LIMITED (COMPANY) PRIVACY POLICY

The Company is committed to protecting and respecting the Buyer's privacy.

This policy (together with the Company's terms of use [hyperlinked] and any other documents referred to in it) sets out the basis on which any personal data the Company collects from the Buyer, or that the Buyer provides to the Company, will be processed by the Company. Please read the following carefully to understand the Company's views and practices regarding the Buyer's personal data and how the Company will treat it.

For the purpose of the Data Protection Act 1998 (the Act), the data controller is Kilfrost Limited of Albion Works, Haltwhistle, Northumberland, NE49 0JH. [The Company's nominated representative for the purpose of the Act is [name].]

Information the Company May Collect From the Buyer

The Company may collect and process the following data about the Buyer:

  • Information that the Buyer provides by filling in forms on Site www.kilfrost.co.uk (Site). This includes information provided at the time of registering to use the Site, subscribing to the Company's service, posting material or requesting further services. The Company may also ask the Buyer for information when the Buyer reports a problem with the Site.

  • If the Buyer contacts the Company, the Company may keep a record of that correspondence.

  • The Company may also ask the Buyer to complete surveys that the Company uses for research purposes, although the Buyer does not have to respond to them.

  • Details of transactions the Buyer carries out through the Site and of the fulfilment of the Buyer's orders.

  • Details of the Buyer's visits to the Site including, but not limited to, traffic data, location data, the weblogs and other communication data, whether this is required for the Company's own billing purposes or otherwise and the resources that the Buyer accesses.

IP Addresses and Cookies

The Company may collect information about the Buyer's computer, including where available the Buyer's IP address, operating system and browser type, for system administration and to report aggregate information to the Company's advertisers. This is statistical data about the Company's users' browsing actions and patterns, and does not identify any individual.

For the same reason, the Company may obtain information about the Buyer's general internet usage by using a cookie file which is stored on the hard drive of the Buyer's computer. Cookies contain information that is transferred to the Buyer's computer's hard drive. They help the Company to improve the Site and to deliver a better and more personalised service.

They enable the Company:

  • To estimate the Company's audience size and usage pattern.

  • To store information about the Buyer's preferences, and so allow the Company to customise the Site according to the Buyer's individual interests.

  • To speed up the Buyer's searches.

  • To recognise the Buyer when the Buyer return to Site.

The Buyer may refuse to accept cookies by activating the setting on the Buyer's browser which allows the Buyer to refuse the setting of cookies. However, if the Buyer selects this setting the Buyer may be unable to access certain parts of the Site. Unless the Buyer has adjusted its browser setting so that it will refuse cookies, the Company's system will issue cookies when the Buyer logs on to Site.

Please note that the Company's advertisers may also use cookies, over which the Company has no control.

Where The Company Stores The Buyer's Personal Data

The data that the Company collects from the Buyer may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for the Company or for one of the Company's suppliers. Such staff may be engaged in, amongst other things, the fulfilment of the Buyer's order, the processing of the Buyer's payment details and the provision of support services. By submitting the Buyer's personal data, the Buyer agrees to this transfer, storing or processing. The Company will take all steps reasonably necessary to ensure that the Buyer's data is treated securely and in accordance with this privacy policy.

All information the Buyer provides to the Company is stored on the Company's secure servers. Any payment transactions will be encrypted [using SSL technology]. Where the Company has given the Buyer (or where the Buyer has chosen) a password which enables the Buyer to access certain parts of the Site, the Buyer is responsible for keeping this password confidential. The Company asks the Buyer not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although the Company will do its best to protect the Buyer's personal data, the Company cannot guarantee the security of the Buyer's data transmitted to the Site; any transmission is at the Buyer's own risk. Once the Company has received the Buyer's information, the Company will use strict procedures and security features to try to prevent unauthorised access.

Uses Made of the Information

The Company uses information held about the Buyer in the following ways:

  • To ensure that content from the Site is presented in the most effective manner for the Buyer and for the Buyer's computer.

  • To provide the Buyer with information, products or services that the Buyer requests from the Company or which the Company feel may interest the Buyer, where the Buyer has consented to be contacted for such purposes.

  • To carry out the Company's obligations arising from any contracts entered into between the Buyer and the Company.

  • To allow the Buyer to participate in interactive features of the Company's service, when the Buyer chooses to do so.

  • To notify the Buyer about changes to the Company's service.

The Company may also use the Buyer's data, or permit selected third parties to use the Buyer's data, to provide the Buyer with information about goods and services which may be of interest to the Buyer and the Company or they may contact the Buyer about these by post or telephone.

If the Buyer is an existing customer, the Company will only contact the Buyer by electronic means (e-mail or SMS) with information about goods and services similar to those which were the subject of a previous sale to the Buyer.

If the Buyer is a new customer, and where the Company permits selected third parties to use the Buyer's data, the Company (or they) will contact the Buyer by electronic means only if the Buyer has consented to this.

If the Buyer does not want the Company to use the Buyer's data in this way, or to pass the Buyer's details on to third parties for marketing purposes, please tick the relevant box situated on the form on which the Company collected the Buyer's data (the order form).

The Company does not disclose information about identifiable individuals to the its, but the Company may provide them with aggregate information about the Company's users (for example, the Company may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). The Company may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in SW1). The Company may make use of the personal data the Company has collected from the Buyer to enable the Company to comply with its advertisers' wishes by displaying their advertisement to that target audience.

Disclosure of the Buyer's Information

The Company may disclose the Buyer's personal information to any member of the Company's group, which means its subsidiaries, its ultimate holding company and its subsidiaries.

The Company may disclose the Buyer's personal information to third parties:

  • In the event that the Company sells or buys any business or assets, in which case the Company may disclose the Buyer's personal data to the prospective seller or buyer of such business or assets.

  • If or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

  • If the Company is under a duty to disclose or share the Buyer's personal data in order to comply with any legal obligation, or in order to enforce or apply the Company's terms of use or terms and conditions of supply and other agreements; or to protect the rights, property, or safety of Kilfrost Limited, the Company's customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

The Buyer's Rights

The Buyer has the right to ask the Company not to process the Buyer's personal data for marketing purposes. The Company will usually inform the Buyer (before collecting the Buyer's data) if the Company intends to use the Buyer's data for such purposes or if the Company intends to disclose the Buyer's information to any third party for such purposes. The Buyer can exercise its right to prevent such processing by checking certain boxes on the forms the Company uses to collect the Buyer's data. The Site may, from time to time, contain links to and from the websites of the Company's partner networks, advertisers and affiliates. If the Buyer follows a link to any of these the websites, please note that these websites have their own privacy policies and that the Company does not accept any responsibility or liability for these policies. Please check these policies before the Buyer submit any personal data to these the websites.

Access to Information

The Act gives the Buyer the right to access information held about the Buyer. The Buyer's right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet the Company's costs in providing the Buyer with details of the information the Company holds about the Buyer.

Changes to Our Privacy Policy

Any changes the Company may make to its privacy policy in the future will be posted on this page and, where appropriate, notified to the Buyer by e-mail.
